There's nothing that says that a "villain" has to be "evil".
Will's motivations are simple--first greed (with some halfway-good intentions, assuming he's going to use it to provide a better life for his children), then blood-soaked revenge, which is a staple of a good villain.
In the scheme of things, perhaps to the audience of the film, he wasn't considered a "villain", but by the end of the film, the characters within the story considered a very dangerous villain.
