EB Games 360 instore special

This is in regards to the EB/Gamestop offer that apparently expired on 1/2/07. The deal was, trade in any original xbox and get $80 credit towards the 360. So apparently the deal ended Tuesday, but as of yesterday and today, the gamestop by my work had the signs up, no expiration date listed on any signs. I take my systems & acces. to the first eb at my mall, no signs, won't help. I quick run down to the EB by my work and they still have the sign up. The guy says no, the promo has ended, I say the sign is up, I would like the offer honored (wasn't too much to ask since they made the mistake of leaving it up) He calls the manager who says try it. I can get the $80 credit but not sure if the free game and 1 year service plan will work. He does my trade in stuff and goes to ring it up. THe game and service plan won't be taken by th ecomputer since the promo is over. I ask polietly is there anything he knows that can be done. He says no. Mind you this is now 8pm at night, i've been there for 30 min just getting my trade ins done. I take the $80 credit and tell the guy, i know its not his fault and he did what he could and I appreciated that. I leave and tomorrow in the morning i'm going to call the manager and explain the situation and ask for the game (Ghost Recon Advanced Warfare) and service plan be added post-sale. If no luck, I'm going to ask for their supervisor.

Am I in the right for asking for the full promotion to be honored since they kept it advertised and I walked in the door. I would assume in retail that they would have to honor it in full or give me some kind of equal compensation? I'll keep you posted

I think you are in the right.

I always harp on my associates to be thorough when pulling sale tags that have an expiration date. Most of them feature mail-in-savings, which are of course valid for that specific week or time period that the sale tag is up. If we don't pull a sale tag and a customer wants the advertised price, I honor it for them. It's easier in the long run to just take care of the customer than to fight them over it, at which point I've lost a customer anyway. Unfortunately, I don't think you'll see anything done for you though. Best of luck though!

Its retail law that they must honor the deal if advertised in the store. They should even have a mention of retail law by the register. This sort of happen to my mom and dad when they bought a TV like 8-9 years ago at a local store. The display sign was to say $50 off the TV but someone had placed a 50% off sign instead. My mom and dad jumped on the tv and because of the law the store (Zellers if anyone wants to know) had to honor their advertisement within the store and sure enough the sign was taken off as my parents payed for the TV. So with the ad in the store still up they would have to honor the deal for you and i would fight for it or some sort of good deal on the side instead (but go for what they advertised)

If the sign had a date on it, then they would really only have to honor the date the sale was in effect.

I don't think there's really any such thing as a retial law, at least not in the US, Canada might be totally different.

False advertising is probably the closest thing you could accuse them of, but again, if thier ads have a date on them, you're stuck.


HOWEVER, I don't think it's very good service, so complaining to the managment is the correct course of action, and what I would do.

Also take into account that both promotions say that they can not be combined with other promotions. We have been through this at work, and according to my DM only one promo is it working properly. I personally think thats retarded, but that was the ruling we got.

Hopefully you can get the freebies too though. One thing I have learned with EB/GS, put up a big enough fuss, and they will give you absoloutely anything.

Well it might not be Retail Law down there like up here but some states do have the same overall effect that it has up here. I know for a fact that had you been in Michigan all you had to say was Michigan Bounty and it would of been honored on the spot(Grandma has done that several times while shopping in Detroit area and the managers get pissed but have to give it too her) So maybe a quick yahoo/google search might show up something for you

update:

I finally got the main store manager on the phone. And after hearing him tell me that there is nothing that he can do. I told him I cannot accept 1/3 of a promotion, even if the sign was left up by mistake. I said that as a consumer I walked into that store with the purpose of getting the promotion on the sign. He was like "I can't short the store a $100 for the game and plan." My reply, the bundle was only the price of the pro plan so how is he shorting the store if the game and protection plan were already rolled together. His reply, "i can see this is going to go in circles, just bring the receipt and the console in and we'll reverse the transaction and get it taken care of." So i'm assuming that that means I'll be getting the game and protection plan. I have to take the console back so they can rescan it and the receipt and hopefully fix it right, if not, his supervisor will get a call tomorrow from me.

Dude you need to call them anyway. Because other people less persistent will get screwed for there mistake. At the grocery store I work at if a sale sign or shelf tag gets left on a particular item an a customer sees it and wants that lower price they get it, period, no questions asked. It was our mistake and we should pay for not being a little more careful with out work.

Its the nature of retail. If the customer isn't pleased then you don't have a business. It's just that simple. Also the manager needs to set the example for his subordinates. If those promotional signs aren't supposed to be there then he should have taken them down. He should also Honor your situation and take down the poster.

sorry for the delay,

Well I got the game and the warranty. Now I have been persistant but nice about it. I constantly thanked the manager and the guy that initially waited on me for patience and everything. I take the console and reciept into the store the other day w/ a girl I work with and I say only the following, "Is Bill the manager here?" The clerk's response, "Oh, you're the guy.?" I was floored, I wanted to punch him the f&ck out. Its one thing if I was a dick to the store or the guy personally and its not like he was losing an hours pay for their mistake. I looked at my friend and was like, "I guess i'm that guy now huh?" I should call and file a complaint. But I did get the game, albeit used, and the one year warranty like, along with the $80 trade in value, I got all I wanted. Thanks everyone for your support and info

You got all that you wanted but the respect you deserve from the guy. He should recognize that you are not being irate but civil in the whole dealings. I would be annoyed

I understand that. But, and I say this as not to stereotype, the guy works at EB Games, which is more or less just another retail job. Sometimes people say something that in their head sounds innocuous enough, but seems insulting to a customer. As in, "You're the customer that we're trying to satisfy" or "You're the customer that my manager was talking about who had a problem" but what he said came out wrong. That's just my take, though. I wouldn't file a complaint unless he was personally nasty to you.

nah i am way over it, i was just going to do it to be a d$ck to the guy but figured it wasn't going to be worth my time, since i'm moving from the area anway don't have to go to that store anymore

Sorry to seem like an instigator here but....

Yeah the clerk meant something buy it. I bet everyone that works in the store and had contact with the initial clerk heard about 'zombi coming into the store. I also pretty much guaranty the clerk blew it out of proportion when he told his co-workers and friends and family members about the guy that made him honor his companies promotion. He may not have meant it personally but it's good that you made an impact somewhere along the way.

You may not be shopping there any more but I bet the next promotion they have like that someone in that store will say something to the effect of "Hey, don't forget to take that poster down you remember 'that guy' from last time".

Everyone should want to be "that guy". It's awful to have to do your job and do it right.
