I too think it's odd that Fay Grim is being shown on HDNet the same date it's premiering in theaters, and it's being released under the HDNet Films banner, but it's coming out on a regular DVD?

Fay Grim seems to be part of the 6-film contract between Magnolia Pictures and HDNet, with the simultaneous theatrical and DVD releases. Most people remember the press from the first release, the low-budget Soderbergh film, Bubble.

I recall a 2nd movie released the same way, the Architect, a few months ago.
